The terms and conditions herein are applicable to customers (“Customer”) of Idaho Power receiving tree(s) through the Idaho Power Shade Tree Project.
Idaho Power residential Customers living in Cassia, Gooding, Jerome, Lincoln, Minidoka and Twin Falls counties with an active Idaho Power account. Customer has the legal right to plant trees on the property.
Customer agrees to plant the tree according to local and state ordinances and to follow the best practices for energy savings provided by Idaho Power.
Customer agrees not to plant this tree within 35 feet of an overhead line and understands trees planted near or under power lines may need to be trimmed or removed by Idaho Power at a later date.
Customer understands and agrees that Idaho Power and/or its representatives may include a description of this project and other project details in its case studies, brochures, news releases, advertisements and other marketing materials presented to the public.
Customer understands and agrees to release name, address, phone and email to the Arbor Day Foundation, and its subcontractors for purposes of enrolling in this program
Customer understands and agrees that a subset of customers will be chosen for program evaluations including follow-up surveys and on-site visits. Customers randomly selected for an on-site program evaluation will be notified in advance.
Disclaimer of Warranties
Idaho Power neither expressly nor implicitly warrants nor assumes any legal liability or responsibility associated with Customer’s participation in the program, including but not limited to the performance, quality, safety, care, maintenance or estimated energy and/or cost savings associated with program participation.
Customer agrees to indemnify Idaho Power, its parent company, affiliates, subsidiaries, directors, officers, employees, agents, representatives, successors and assigns of each against all loss, damage, expense and liability arising from participation in this program.
Trees will not be replaced by Idaho Power or partners, including participating nurseries.
