The Organizational and Professional Development Grant, and “Energy for Growth” Marketing Grant (together, a “Grant,” and collectively the “Grant Program”), and all associated programs are subject to all federal, state, local and municipal laws and regulations and are void where prohibited by law. No purchase is necessary to enter or win.
In these Terms and Conditions, the term “Participant” means a qualifying organization meeting the eligibility criteria described in these Terms and Conditions that submits an application on the form approved by Idaho Power (“Application”) and, where an individual submits an Application on behalf of an organization or his or her self, collectively such person and the organization on whose behalf the individual has submitted an Application.
Participation in the Grant Program is open to legal residents of the United States who are 18 years of age or older at the time of entry, currently residing in one of the 50 United States or the District of Columbia at the time of submitting an Application. Only those Participants who conduct or perform a significant portion of their qualifying programs within Idaho Power Company’s authorized service area (encompassing a designated area of southern Idaho and eastern Oregon) are eligible to apply to receive an award in the Grant Program. Eligibility of Participants is subject to verification by Idaho Power Company.
Eligibility for participation in the Grant Program and submission of a qualifying Application does not guarantee the receipt of a Grant by a Participant. Only a limited number of Grants are available for award and, accordingly, only a small number of prospective Participants who submit an Application may ultimately receive a Grant.
Any Applications or prospective Participants that to any degree suggest any of the foregoing are not eligible for a Grant and may not be a Participant:
- suggest legalization of any illegal drugs/activity, prostitution or pornography, or other similar activities or goods which, in Idaho Power Company’s sole discretion are inappropriate for publication or display;
- challenge, lobby for or seek to change current laws, enact any new laws, or overthrow of any government;
- are inconsistent with these Terms and Conditions;
- are inconsistent with any corporate policy of Idaho Power Company;
- suggest or encourage the taking up of arms against any person, government, or entity;
- discriminate against, disparage or denigrate any race, age, gender, disability, sexual orientation, ethnicity, religion, political orientation, national origin, ancestry, marital status, veteran status, or mental or physical disability;
- disparage or denigrate a product, service, person, company, or organization including, but not limited to, Idaho Power Company or its affiliates;
- promote alcohol, illegal drugs or activity, tobacco, firearms/weapons, prostitution, or pornography;
- contain any profanities, be overtly sexual, suggest an intent to abuse, or suggest violence;
- contain photos or videos which have images of violence, drugs, pornography, or other similar activities or goods or services;
- involve religious advocacy, proselytizing – acts and intentions to advance a religious denomination or expand membership or encourage conversion;
- involve activities by a religious organization whose purpose is only to provide services/goods/benefits to their congregation rather than all members of their community;
- involve political advocacy – acts and intentions to advance a particular political party, candidate, and/or cause or to support lobbying for any particular party, candidate, and/or cause, or to expand membership or to encourage membership for a particular political party, candidate, or lobbying effort;
- involve furtherance or expansion of a particular political policy or agenda or social policy or agenda with legislative implication;
- describe a project that directly or principally benefits a specific individual (as opposed to the identified community as a whole);
- violate any third-party intellectual property rights;
- request funding to obtain U.S. Internal Revenue Code Section 501(c)(3) or other federally tax-exempt organization status; and
- are a duplicate idea for the same organization or project previously submitted.
- Idaho Power Company also reserves the right to deny an Application or cancel any Grant and to take any further action it desires if Idaho Power Company determines, in its sole discretion, that Participant may engage, engaged, or participated in any fraudulent activity at any time in connection with submission of an Application or during the Grant Program.
How to Enter:
Entrants must complete all information requested in an Application. LIMIT ONE (1) ENTRY PER PARTICIPANT. An organization that submits an Application must designate one (1) individual as the Participant to submit the Application. Idaho Power Company, in its sole and absolute discretion, will decide if written documentation provided is sufficient, and may at its sole discretion request additional documentation from the person or organization seeking to be a Participant. Idaho Power Company is not responsible or liable for any disputes between Participants and organizations arising under or related to the Grant Program.
Grant Value and Odds:
Idaho Power will award multiple grants and each Participant that is selected by Idaho Power Company to receive an award may receive up to, and not in excess of, $750 for an Organizational and Professional Development Grant or $3,000 for an “Energy for Growth” Marketing Grant. In the case of an “Energy for Growth” Marketing Grant, Idaho Power Company retains discretion as to the amount provided, but in no case will it exceed 50 percent of the program cost.
Idaho Power Company reserves the right to select, in its sole discretion, the prospective Participants that will be Grant recipients and the dollar amount of Grant awards to each Participant chosen by Idaho Power Company. Each Participant will be bound by the decisions of Idaho Power Company, which shall be final and binding in all respects and not subject to challenge on any basis. A Participant may decline to receive an award under the Grant Program. Arrangements for delivery of Grants will be performed after grant recipient validation. Each Participant that receives a Grant is solely responsible for all applicable federal, state, and local income and any other taxes, fees, and surcharges.
Odds of receiving a grant depend on the number of Applications received. Winners will be notified by either e-mail or telephone. Idaho Power Company may determine not to award an unclaimed Grant or may provide the unclaimed Grant to an alternate Participant.
Grant Program applications are due March 15 and grant recipients will be notified on or around March 30. Recipients of Organizational and Professional Development Grants may be notified sooner.

Appropriate Conduct and Content:
A Participant may not use the Grant Program for any illegal or unauthorized purpose. Participants are solely responsible for their own conduct and any data, text, information, photos, videos, links, and other media and content submitted, shared, and displayed by the Participant during or through the Grant Program. Opinions and views expressed by Participants are not necessarily those of Idaho Power Company or its employees or affiliates.
Changes to These Terms and Conditions:
Idaho Power Company reserves the right to modify, suspend, discontinue, or permanently cancel the Grant Program for any reason, and without notice, without liability to Participants or any third party. Idaho Power Company will not be responsible for archiving or storing any Applications, and thus Participants should retain a copy of the Applications for Participant’s own records. Idaho Power Company also reserves the right to modify these Terms and Conditions from time to time without notice. Participant is responsible for regularly reviewing these Terms and Conditions so that Participant will be apprised of any changes.
License to Use Applications and Content:
By submitting an Application and any other materials, photos, artwork, and other media (the “Content”) to Idaho Power in connection with the Grant Program, Participant grants Idaho Power Company and its affiliates a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license (with the right to sublicense) to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute (through multiple tiers), and display, without compensation of any form, such Content as part of the Grant Program and in all media whatsoever, without limitation as to geographic scope, duration, or frequency of usage that are used by Idaho Power Company or its agents in connection with the promotion, marketing, use, or expansion of the Grant Program, or for any other purposes as Idaho Power Company or its affiliates may elect in connection with its business or marketing and promotion efforts or otherwise.
Participant represents to Idaho Power Company that Participant (in the case of an individual submitting an Application on behalf of an organization or entity, such organization or entity) owns all Applications and Content provided to Idaho Power Company in connection with the Grant Program and/or has the unencumbered legal right to grant the above-referenced license with respect to all such Content provided. Participant further represents to Idaho Power Company that such Applications and Content do not infringe any third-party copyrights or other third-party intellectual property rights.
Idaho Power Company, the Idaho Power Company logo, and the related logos, slogans, graphics, page headers, and service names displayed on the Grant Program are trademarks of Idaho Power Company or its affiliates. Use or reproduction without permission is strictly prohibited. All items in or on the Grant Program supplied by Idaho Power Company, including, but not limited to, text, images, graphics, audio, and video, may not be used, reproduced, displayed, or modified without the prior written permission of Idaho Power Company. Idaho Power Company’s trademarks and trade dress may not be used in connection with any service that is not Idaho Power Company’s, may not be used in any manner that is likely to cause confusion among customers, or may not be used in any manner that disparages or discredits Idaho Power Company.
Representations and Indemnification:
Participant represents and warrants to Idaho Power Company that its use of the Grant Program does and will comply at all times with these Terms and Conditions. Participant agrees to defend, indemnify, and hold harmless Idaho Power Company and its and their employees, agents, directors, officers, and affiliates for, from, and against all the liabilities, claims, damages, losses, and expenses (including reasonable attorneys’ fees and costs) arising out of or relating to Participant’s breach or alleged breach of these Terms and Conditions and Participant’s breach or alleged violation of the copyright, trademark, proprietary, or other intellectual property or other rights of third parties.
Responsibility for Costs; Disclaimer of Warranties:
Participant acknowledges and agrees that neither Idaho Power Company nor any of its employees or affiliates shall have any liability to Participant, or to any third party, for any modification, suspension, discontinuance, or termination of the Grant Program and/or any service, or any part thereof. Participant understands and agrees that Participant is responsible for any and all charges, costs, and expenses for Participant’s preparation of the Application and compliance with its obligations under the Grant Program. No advice or information, whether oral or written, obtained by Participant from Idaho Power Company or through the Grant Program shall create any warranty not expressly made herein.
Limitation of Liability and Release of Liability:
NEITHER IDAHO POWER COMPANY NOR ANY OF ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS, OR ASSIGNS SHALL BE LIABLE TO PARTICIPANT OR ANY OTHER PERSON OR ENTITY FOR ANY DAMAGE CAUSED IN ANY PART BY PARTICIPANT’S PARTICIPATION IN THE GRANT PROGRAM, OR FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, PUNITIVE, SPECIAL, OR SIMILAR DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. PARTICIPANT AGREES THAT PARTICIPANT’S PARTICIPATION IN THE GRANT PROGRAM IS AT PARTICIPANT’S SOLE RISK. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF IMPLIED WARRANTIES OR LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO PARTICIPANT.
Applicable Law and Disputes:
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Idaho (without reference to its choice of law provisions), as they apply to agreements made and performed in the State of Idaho. All disputes concerning these Terms and Conditions shall be heard in either the Judicial District Courts of the State of Idaho or the United States District Court for the District of Idaho, and each of the parties hereby waives any objection that it may have to of the exclusive venue in such courts.
Entire Agreement and Severability; Survival of Terms:
These Terms and Conditions constitute the entire agreement with Idaho Power Company with respect to Participant’s participation in the Grant Program. If any provision of these Terms and Conditions is determined to be unlawful, void, or unenforceable, then that provision shall be deemed severable from the remaining provisions and shall not affect their validity and enforceability.
If Participant Does Not Agree:
IF THESE TERMS AND CONDITIONS ARE NOT ACCEPTABLE TO A PROSPECTIVE PARTICIPANT IN FULL, THEN SUCH PROSPECTIVE PARTICIPANT MAY NOT PARTICIPATE IN THE GRANT PROGRAM.
